1. Agreement
These Terms of Service (“Terms”) govern your use of the Family Bible website, applications, and services (collectively, the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy.
2. Eligibility
You must be at least 13 years old to use the Service. If you are in the European Economic Area, the United Kingdom, or another region with a higher digital-consent age, you must meet that age. By registering you represent that you meet these requirements.
3. Your account
You are responsible for the activity on your account and for keeping your password confidential. You agree to provide accurate information, to notify us of any unauthorized access, and to use strong authentication practices.
You may name a successor to take over your account if you become unable to manage it. Succession only occurs after we verify your status through a documented process.
4. Your content
You retain all rights in the content you upload (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and transmit Your Content solely for the purpose of operating and providing the Service to you and to the family members you explicitly share it with. We do not claim any ownership of Your Content and we do not use it for advertising personalization.
You are responsible for ensuring you have the right to upload and share Your Content, including with respect to other people depicted.
5. Acceptable use
You agree not to:
- Upload content that is unlawful, defamatory, infringing, harassing, hateful, sexually exploitative, or that depicts minors in a sexual or abusive manner.
- Attempt to access accounts or data that do not belong to you, or probe, scan, or test the vulnerability of the Service without our written permission.
- Use the Service to send spam, malware, or unsolicited marketing.
- Use automated means to scrape or replicate the Service.
- Resell, rebrand, or otherwise commercialize access to the Service.
We reserve the right to remove content, suspend accounts, and cooperate with law enforcement to address violations.
6. Our intellectual property
The Service, including its software, design, text, graphics, logos, and the “Family Bible” name and wordmark, is owned by Paul Pool and protected by copyright, trademark, and other intellectual-property laws. “Family Bible” ™ is a common-law trademark of Paul Pool; all rights reserved.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the Service or our marks without our prior written permission, except as expressly permitted by law.
7. Advertising
The Service may display advertising. Advertisements are clearly labelled as “Sponsored.” You can turn off personalized advertising at any time from privacy choices.
8. Fees and paid plans
Basic accounts are free. If you purchase a paid plan, additional terms presented at checkout apply. We may change pricing on reasonable notice.
9. Termination
You may close your account at any time from your account page. On deletion we cascade removal of your data across every internal service. Backup copies expire within 30 days.
We may suspend or terminate your account if you materially breach these Terms, if required by law, or to protect other users.
10. Warranty disclaimer
The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be error-free or uninterrupted.
11. Limitation of liability
To the maximum extent permitted by law, Family Bible will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill arising out of or in connection with the Service. Our aggregate liability will not exceed the greater of fifty U.S. dollars ($50) or the amounts you paid us in the twelve months preceding the claim.
12. Indemnity
You agree to indemnify and hold us harmless from claims arising out of Your Content or your breach of these Terms, to the extent permitted by applicable law.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in New Castle County, Delaware, unless applicable consumer-protection laws give you the right to proceed in another forum.
14. Changes to these Terms
We will announce material changes by email or a prominent notice in the app. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
